Madad Inc Charity Auction – Terms & Conditions

1. Agreement to Terms

 

By registering, bidding, or participating in the Madad Inc Charity Auction (“Auction”), you (“Bidder”) agree to be legally bound by these Terms & Conditions.

This Auction is operated by Madad Inc in accordance with applicable laws of the State of Illinois.

2. All Sales Final – “As Is”

All items are sold “AS IS,” “WHERE IS,” and “WITH ALL FAULTS.”

Madad Inc makes no warranties or guarantees, express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Authenticity or provenance

ALL SALES ARE FINAL. NO RETURNS. NO REFUNDS.

3. Authenticity & Memorabilia Disclaimer

Sports memorabilia (including autographs, game-used items, and collectibles) may:

  • Include third-party authentication
  • Be described based on available information

However, Madad Inc:

  • Does not guarantee authenticity unless explicitly stated
  • Does not guarantee game-used claims or provenance
  • Is not responsible for errors in descriptions or labeling

Descriptions and images are opinions only, not warranties.

4. PSA / Grading-Specific Terms (High-End Card Buyers)

For graded cards (PSA, BGS, SGC, etc.):

  • The assigned grade represents the opinion of the grading company at the time of encapsulation
  • Card condition may appear different in person vs. images
  • Slabs/cases may have minor scratches or wear not affecting the grade

Madad Inc makes NO guarantees regarding:

  • Regrading outcomes
  • Cross-grading results
  • Subgrades or centering interpretations
  • Long-term slab condition

👉 Buyers are responsible for reviewing certification numbers directly with grading companies (e.g., PSA Cert Verification).

5. Raw Cards & Ungraded Items

For ungraded (“raw”) cards and memorabilia:

  • Condition is subjective and may vary by collector standards
  • No guarantees are made regarding grading potential
  • Cards may contain flaws not visible in images (e.g., surface, centering, edges)

👉 Assume raw cards may not grade as expected.

6. Bidding is Legally Binding

All bids constitute a binding contract to purchase.

Winning bidders agree to:

  • Pay the final bid amount (“hammer price”)
  • Pay applicable Illinois sales tax (if required)
  • Pay shipping, handling, and processing fees

Failure to pay may result in:

  • Order cancellation
  • Account suspension or ban
  • Legal action to recover damages

 

 


7. Payment Terms

 

Payment must be completed within 48 hrs of auction close.

Accepted payment methods:

  • Shopify Payments / Credit Card
  • Other approved methods (if applicable)

Unpaid items may be:

  • Offered to the next highest bidder
  • Relisted at Madad Inc’s discretion

8. Shipping & Risk of Loss

  • Items will be shipped to the address provided at checkout
  • Risk of loss transfers to the buyer upon delivery to the carrier

Madad Inc is not responsible for:

  • Carrier delays
  • Lost or damaged packages after shipment (unless insured and claimed properly)

9. Limitation of Liability

To the fullest extent permitted under Illinois law:

Madad Inc shall not be liable for:

  • Any indirect, incidental, or consequential damages
  • Loss of investment value or resale opportunity
  • Errors or omissions in listings

 

Maximum liability, if any, shall not exceed the purchase price paid for the item.

10. No Investment Representation

All items are sold as collectibles only.

Madad Inc makes no representation that any item will:


  • Increase in value
  • Maintain value
  • Perform as an investment

 

 

11. Dispute Resolution (Illinois-Specific)

 

Any disputes arising from this Auction shall be governed by the laws of the State of Illinois.

Venue shall be exclusively in:

👉 Cook County, Illinois


By participating, bidders consent to jurisdiction in Illinois courts.

 

 


12. Chargebacks & Fraud Prevention

 

Initiating a chargeback without valid cause constitutes a breach of these Terms.


Madad Inc reserves the right to:

  • Dispute chargebacks with supporting evidence
  • Ban users from future auctions
  • Pursue legal remedies


13. Right to Refuse or Cancel

 

Madad Inc reserves the right to:


  • Reject any bid
  • Cancel any auction
  • Refuse service to any user



At its sole discretion, for any reason.
